Boy, I should think you’d get a lot farther in a lawsuit if you actually started off with proving they use a defeat device, rather than running off an assumption that they do.

I am a lawyer, and you have to do discovery to get documents to figure out what’s going on. Apparently these guys figure they can get to that stage of the lawsuit - i.e. get past the inevitable motion to dismiss. And I wonder if this is going to be VW - deny deny deny, then shrug and admit it.

Curious to see how this plays out. They’ve tried before but haven’t gotten anywhere. They’re accusations are all over the board, first it was “over 65x the limit”, then 8-19, and also 31. Can I sue the weather man because his forecast was wrong?

They’ll hire experts for discovery and trial - on both sides. VW’s only real defense will be to prove no harm to the owners, but they’ll need a fix that doesn’t affect performance, which may be impossible. Damage calculations will involve the diminished value of the cars. I don’t know a whole lot about the case so this is mostly spitballing. And this tarnishes one of my favorite methods of propulsion - the diesel engine.
